Today’s Legal Updates :

  1. Today The Tamil Nadu government approved the engagement of 29 senior advocates, apart from the Attorney General for India the Solicitor General of India and all ASGs, to represent the State in cases before the Supreme Court.
  2. Today the Delhi High Court held while rejecting the claim made by a man in a matrimonial dispute, It is unheard of in our society that a man who is already in emotional distress on account of a matrimonial dispute, would be disowned by his parents.
  3. Today The Central government informed the Delhi High Court that, in compliance with previous orders, a digital crowdfunding platform has been set up and made operational for aiding the treatment of rare diseases.
  4. Today The Karnataka High Court held that orders passed under Section 12 of the Protection of Women from Domestic Violence Act, 2005 (DV Act) can be enforced in the same manner as laid down in Section 125 (Order for maintenance of wives, children and parents) of the Code of Criminal Procedure.
  5. Today The Delhi High Court remarked that in recent cases involving bribery charges, people have adopted “novel ways” of accepting bribes where the tainted money was either asked to be put in a place or left somewhere.
  6. Yesterday The Supreme Court held that the state government is empowered to grant remission of sentence to a prisoner only if he has undergone 14 years of actual imprisonment. If the imprisonment is less than 14 years, premature release can exclusively be granted by the Governor, on the aid and advice of the state.
  7. Today The Kerala High Court held that the manipulation of any part of the body of the victim to get the feeling or sensation of penetrating an orifice would attract the offence of rape as defined under Section 375 of the Indian Penal Code. 
  8. Today The Delhi High Court ordered that the custody of a woman suffering from Hypoxic Brain Damage, on account of her in-laws trying to kill her, be given to her father and not her husband.
  9. Today The Supreme Court held that an application under Section 7 of the Insolvency and Bankruptcy Code (IBC) would not be barred by limitation, on the ground that it was filed beyond a period of three years from the date of declaration of the loan account of the Corporate Debtor as Non-Performing Asset (NPA).
  10. Today the Bombay High Court challenging the scope of the Single Member High Level Inquiry Committee headed by retired Justice KU Chandiwal and the directions issued for his appearance before the Committee.
  11. Yesterday The Calcutta High Court ruled that choosing foreign law to govern arbitration would not, by itself, exclude the application of Section 9 of the Arbitration Act, which allows parties to approach Indian courts for interim protection or reliefs.

Today The Supreme Court has sought the assistance of the Attorney General and Solicitor General in a plea challenging the validity of the Central government’s notification transferring the jurisdiction of Debt Recovery Tribunal (DRT), Jabalpur to DRT, Lucknow due to unavailability of a presiding officer at Jabalpur.
  14. Today the Punjab & Haryana High Court observed prompting it to transfer the investigation in a drug related case to the Central Bureau of Investigation (CBI) Punjab State functionaries are intentionally protecting the drug offenders.
  15. Yesterday The Punjab & Haryana High Court granted bail to Dalbir Singh (petitioner), a famer arrested under the sedition law for allegedly making derogatory remarks against the Chief Minister of Haryana, Manohar Lal Khattar. 
  16. Today The Karnataka High Court sought the response of the State government and Bruhat Bengaluru Mahanagara Palike (BBMP) on a petition challenging the levy of property tax on unused/ shut buildings during the COVID-19 lockdown.
  17. Today The Supreme Court worked out a settlement in between a husband and wife locked in matrimonial dispute after the husband agreed that he will not torture the wife and will withdraw all cases filed against her including the divorce petition.
  18. Today The Bombay High Court reserved its verdict in the petition filed by lawyer and Bhima Koregaon accused Sudha Bharadwaj seeking default bail under Code of Criminal Procedure.
  19. Today Chief Justice of India (CJI) NV Ramana recused from hearing the water dispute between Andhra Pradesh (AP) and Telangana after AP opposed the CJI’s proposal for mediation in the matter.
  20. Today The Calcutta High Court has imposed costs of Rs. 40 Crores as a condition for compounding offences charged against a man (petitioner) for felling of over 60 trees.
  21. Today The Punjab and Haryana High Court has directed the Superintendent of Police, Palwal to investigate the circumstances of a marriage solemnized between a 19-year-old girl and a 67-year-old man.
  22. Today The plea challenging the transfer of probe in the Bhima Koregaon case from Pune Police to the National Investigation Agency (NIA) is a “desperate attempt to thwart the investigation pertaining to the Bhima Koregaon case of 2018”, the Central government submitted before the Bombay High Court.
  23. Yesterday The Patna High Court has denied anticipatory bail to two men who allegedly took vulgar and obscene photographs with an idol of Goddess Saraswati and posted them on social media.
