Today’s Legal Updates:

  1. Today retired judge of Supreme Court Justice Gopala Gowda said that “The Unlawful Activities Prevention Act (UAPA) restricts the role of courts to examine the case of prosecution while considering grant of bail and precludes bail if prosecution version appears true on the face of it”.
  2. Today the Himachal Pradesh High Court observed while granting anticipatory bail to a pregnant woman who was co-accused in a case registered under the Narcotic and Psychotropic Substances Act (NDPS Act).
  3. Yesterday The Calcutta High Court emphasised that the right of senior a citizen to exclusively reside in his own house must be viewed from the prism of Article 21 of the Constitution of India.
  4. Today a petition has been filed before the Kerala High Court seeking directions to be issued to the Central government and the National Commission for Minorities urging them to reassess the minority status of Muslims and Christians in the State of Kerala and redetermine the list of minorities.
  5. Yesterday a Delhi court said that Right to bail is a statutory recognition of the sacrosanct principle of presumption of innocence, while granting bail to a Chinese national accused of illegally staying in India and securing a passport after marrying an Indian woman.
  6. On 19th July 2021 the Supreme Court quashed the criminal proceedings initiated against DMK Rajya Sabha lawmaker RS Bharathi under the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act for a speech he made in 2020.
  7. Yesterday The Madras High Court expressed reservations about the 2018 report of the Law Commission of India on legal framework relating to gambling and sports betting in India.
  8. Although it appeared to be delayed, justice finally came in the form of an order from the Karnataka High Court over the application of Twitter application by Manish Maheshwari to oppose the Uttar Pradesh police notice given to him.
  9. Yesterday The Kerala High Court extended the life of all interim orders passed by all courts and tribunals falling under the supervisory jurisdiction of the High Court till August 9, 2021.
  10. Today The Uttarakhand High Court reminded the State government and the Uttarakhand Transport Corporation that depriving the Corporation’s workers of their monthly salaries violates their rights under Articles 21, 23 and 300-A of the Constitution of India.
  11. On 19th July 2021, a notification issued by Delhi Lieutenant Governor (LG) Anil Baijal extended powers under the National Security Act (NSA) to Delhi police commissioner designating him as a “detaining authority”.
  12. Yesterday The Madras High Court issued notice to the Central government in a plea challenging an NGT office order which states that suo motu matters having pan-India or Inter-State implications will henceforth be listed before at least three members of the National Green Tribunal (NGT), Principal Bench at Delhi. 
  13. Today The Allahabad High Court has stayed criminal proceedings against a man who was booked for a Facebook post after he lost his wife during the course of medical treatment at a hospital.
  14. Today The Kerala High Court offered interim relief to several farmers by allowing them to hunt the wild boars that destroy their agricultural lands.
  15. Today the National Investigation Agency (NIA) submitted copy before the Bombay High Court in the Bhima Koregaon case, Merely because a court is not empowered by law to take cognizance and yet does so in good faith does not mean that the proceedings should be set aside on that ground alone.
  16. Today A Mumbai Court directed the Narcotics Control Bureau (NCB) to return electronic devices belonging to Bollywood actor Arjun Rampal and his partner Gabriella Kyriacos Demetriades seized by the agency in a case under the Narcotic Drugs and Psychotropic Substances (NDPS) Act.
  17. Yesterday The Supreme Court declined to disclose details regarding the suggestion made by the Supreme Court Bar Association (SCBA) to elevate Supreme Court lawyers as High Court judges.

  19. Today The State government of Kerala made a bold move by directing all its male employees to sign an undertaking form declaring that they will not promote or accept dowry upon marriage.
  20. Today A Mumbai based lawyer has approached the Bombay High Court comparing the Bar Council of India’s (BCI’s) amended rules prohibiting BCI or a judge’s public criticism to “suppressing dissent” under the Unlawful Activities (Prevention) Act.
  21. Today The Himachal Pradesh High Court has sought response of the State Government on the availability of covid 19 facilities in the State with regards to the ambulances, hospitals including mental health hospitals and pediatrics facilities with regards to children.
  22. The Kerala High Court earlier this week ruled that the petitioner cannot be asked to pay a fine for delayed presentation of a document under the Registration Act if such delay was caused due to the wrongs committed by Sub Registrar.
  23. Today the Allahabad High Court denied bail to two gang rape accused Observing that in villages, towns, and semi-urban areas, there is no effect of women’s awakening going on for centuries but traditionally women are unsecured, deprived of equal rights, deprived of the right to redress injustice.
  24. Today The Madhya Pradesh High Court has observed that not permitting a rape victim, suffering from severe mental problems, to undergo Medical Termination of unwarranted pregnancy would be violative of her bodily integrity.
  25. Yesterday The Supreme Court adjourned the plea by Matrix Cellular Limited against Delhi High Court’s order denying relief in its plea seeking immediate release of its oxygen Concentrators seized by Delhi Police.
  26. Today The Delhi High Court has directed the Delhi Government to file its reply on a petition seeking declaration of Fair price shop dealers as frontline workers amid Covid-19 pandemic.
  27. The Kerala government has declared that it will observe November 26 as Dowry Prohibition Day in the State.
